General Terms and Conditions (GTC) of Steinmann International

 

General provisions

Scope

• These General Terms and Conditions (GTC) govern all legal relationships between us and our customers and apply to all of our services and products.

• They are an integral part of all quotations, assignment confirmations and appointment bookings.

• The general provisions apply as long as the following special provisions do not include different rules for specific services.

 

Accepting Assignments

• An assignment is accepted if

  • a written confirmation of assignment or a written appointment reservation has been made,

  • an oral appointment reservation has been made, provided that it can be clearly seen from the circumstances that the client was willing to purchase these services on the specified date, or if it was clear for the client that we had reserved the specific dates and resources,

  • A written offer exists and we have started to work with evident agreement of the client.

 

Payment and payment terms

• For longer assignments we reserve the right to charge an advance fee of up to 50% of the budgeted assignment value or the full fee of assignments with a fixed fee, on acceptance of the assignment.

• When booking coaching appointments, coaching packages or when ordering products and services, payment becomes due at the time of booking or ordering and will be invoiced accordingly.

• Otherwise accounts for our services and expenses are generally made monthly and no later than at the end of the assignment.  Our clients agree to pay our invoices within the agreed payment period. For our invoices the payment period is 10 days from the date of the invoice unless expressly agreed otherwise.

• In all transactions chargeable to VAT this will be charged in addition to the chargeable amount at the currently applicable rate of VAT on the day of issuing the invoice.

• Missed appointments or phone calls will be invoiced in full.

 

Confidentiality / Privacy / Copyright

• We respect your privacy and will not share any personal information with third parties.

• We will inform you about news and events from Steinmann International, unless you tell us that you have no interest in it.

• All course materials are protected by copyright and may not be copied without the written permission of Steinmann International or distributed or forwarded to third parties.

 

Limitation of Liability

• Our contract partners agree and recognize that:

  • coaching is not therapy and can in no way replace it;

  • the coach may, as required, suggest possible specialists or therapists;

  • the success of the coaching process is dependent on the individual’s actions and choices and not on the responsibility of the coach;

  • they take full responsibility for all actions and results which may arise directly or indirectly from the coaching process;

  • coaching results are not guaranteed;

  • they are fully responsible for all of their feelings, thoughts, decisions and actions.

• Our contracts represent the provision of services to the client. The contractual relationship is not a production contract. There is therefore no guarantee that a client will achieve any specific expected or unexpected results from our services.

• Any liability for personal, property or financial loss which may arise to any client or other person as a result of our services is excluded if the liability can be lawfully excluded.

 

Adjustments

• We reserve the right to change or cancel products, services and prices that are offered on the website without prior notice.

• If any individual provision of this contract is or becomes invalid, the remaining provisions of the contract continue to be valid and the invalid provision shall be replaced by one that comes closest to its intended purpose.

 

Special provisions

 

Coaching

• Any changes or cancellations of appointments or phone calls will not be charged if made at least one day in advance.

• Cancellations less that 24 hours before the appointment or missed appointments will be charged in full.

 

Workshop / Retreat

• Registration
  Registration for our workshops and retreats must be in writing or via the Internet. You will receive a confirmation via e-mail. By registering you also accept these terms and conditions.

• Payment
  With your confirmation you will receive an invoice. The registration is binding, and your place is reserved only when we receive full payment. Places will be allocated in order of received payments (full amount). The early booking discount ends at midnight on the specified date.

• Cancellations
  Refunds will be granted according to the following terms:

-      61 calendar days or more 100%

-      31-60 calendar days 50%

-      30 calendar days or less 0%

Cancellations must be signed and made in writing to Steinmann International. If we find a replacement participant in time (e.g. on a waiting list), we will not charge a fee from you.

• Disclaimer
  If the workshop or retreat is cancelled due to trainer illness or some other reason beyond the control of Steinmann International, we cannot be held responsible for running the workshop. The entire amount paid will be refunded within a week of cancellation, without interest, or you can postpone your attendance to the next available date. Workshops may be postponed or cancelled if not enough registrations are received.

• Insurance
  Participants are always responsible for insurance.

 

Jurisdiction

• Any contractual relationship with us is exclusively subject to Swiss law.

• Jurisdiction for disputes arising is at the place of our registered office. We reserve the right, according to our requirements, to choose to enforce the jurisdiction of the registered office or the residence of the client.   This term is subject to mandatory places of jurisdiction.
